What is public liability insurance?

If an accident or unforeseeable incident causes damage or injury to someone (other than your employees), you may be found legally liable to cover the costs. Public liability insurance can help to protect you from the financial risk of liability claims – giving you the certainty you need to trade with confidence.

Within the sporting industry, public liability risks vary depending on the type of sport and facility, number of members, visitors, and participants whether the sport is incorporated together with the possibility and quantum of visitors.

Although the size and type of operations may vary, the combination of large concentrations of people, dim lighting, inadequate surfaces and the possibility of fire and fights within your facilities can generally increase loss potential.

Example areas of liability include:

  • General public liability risks at the premises including tenant liability for leased premises and property owner’s liability in respect of any restaurant/bar, office, car park, changing rooms, pavilions or grandstands and sports facilities.
  • Liability for accidents on or adjacent to the sports fields/facilities including both participation risk and member to member cross liabilities.
  • First aid treatment risks by volunteers.
  • Umpire/referee liabilities.
  • Children’s facilities and children’s sports/participation.
  • Property in physical and legal control.
  • Liquor liability.
  • Unregistered vehicles e.g., grounds-keeping vehicles.
  • Tours including overseas tours/events.

What is product liability insurance?

Product liability insurance is designed to provide protection if you’re sued because a product you sell, assemble or supply has caused harm to a person or property.

Within the sporting industry, product liability exposures can arise from the sale of/provision of contaminated food and beverages and sports equipment. Most claims arising under product liability will result from foreign objects in food or drink and food poisoning. Where applicable, claims from sports equipment sales are relatively infrequent but could arise in relation to poor assembly, adjustment or alterations of equipment for example, although most claims will be directed at manufacturers.

Other products may include merchandise. Although such products are likely to be manufactured by others, in many cases, they will contain branding specific to the operation and could be imported. The operation could be held liable for any imported goods.

Often this cover is incorporated into an extended Public & Products liability policy or within applicable Association/Management Liability coverage, as opposed to a stand alone policy.

Keeping sports safe

Anyone with the official capacity to organise and manage sporting programs, such as sporting clubs and associations, has a duty to ensure the sport is as safe as possible for participants. If this duty is breached, and a participant get seriously hurt, they may be entitled to compensation.

This commonly includes circumstances where an injury arises because of:

  • An unsafe playing pitch, surface or dangerous sporting grounds
  • Faulty or defective sporting equipment
  • A referee or umpire failing to ensure the reasonable safety of the players, or
  • Inadequate supervision by a trainer or instructor.
