What is Professional Indemnity insurance?

Professional Indemnity Insurance provides protection against the legal costs and claims for liabilities associated with allegations of negligence, professional misconduct, breach of duty or incorrect advice that you provide to a third party.

If found liable for negligence, the costs can be financially devastating. Not only can it lead to an expensive lawsuit, but your’ hard-earned reputation may be damaged as a result.

That’s why professional indemnity insurance matters – for help protecting your assets and brand if your advice causes a third party to take legal action against you.

Who should consider it?

Whether you are a sporting association, coach, trainer, sporting official, fitness professional, sports agent or allied health professional, anyone providing services and advice within the sporting industry can be open to the risk of negligence lawsuits or claims.

For example, as a fitness professional, there are several situations that might put you at risk of a professional indemnity claim, including:

  • Failing to take a client’s medical history or conduct a sound health assessment
  • Inadequate supervision during a client session
  • Failing to take adequate measures to prevent injury
  • Pushing clients beyond their capacity
  • Failing to warn clients of the potential dangers of certain exercises
  • Creating a training plan that is not suited for a client

Importantly, no matter what your profession, no one is immune to the risk of making a mistake, and professional indemnity insurance may be a key measure to help safeguard your future success.

Seek advice from HDL

Many sporting organisations ideally need Professional Indemnity insurance cover to protect any representative providing professional advice including coaches, trainers and medical staff.

Potential exposures include:

  • Working with children where junior sports or instruction is offered.
  • Sports instruction depending on whether the instructors are employees, volunteers or independent contractors.
  • First aid by volunteers or employees - note: volunteers who are not medical professionals may be covered under the public liability policy.
  • Breaches of privacy legislation

Often this cover is incorporated into an extended Public & Products liability policy or within applicable Association/Management Liability coverage, as opposed to a stand alone policy.

HDL can provide advice on what coverage is required based on your particular risk needs together with how coverage should be correctly structured.

Unsportsmanlike behaviour

Sometimes conduct goes beyond what’s expected of the particular sport.

If a participant is hurt from an illegal tackle, an intentional punch or other dangerous behaviour that clearly falls outside the rules of the game, the voluntary assumption of risk defence can crumble. By participating in sport, you don’t sign up to any and all dangerous conduct that arises, only what’s expected as an ordinary part of the game.

In these cases, the individual or body responsible for the participants injury may be liable to pay damages to help cover the cost of medical expenses, treatment costs and lost wages.
